Minutes of the Meeting of July 22, 2004.

PRESENT: Paul B. Carroll, Chairman
 James F. Fitzgerald, Jr.
 Gregory L. Pando

ALSO
PRESENT: Sue Franco, Recording Secretary

Mr. Carroll opened the Meeting at 7:00 p.m. in the Salah Hearing, Memorial Hall.

John Cruznale - 250 Bailey St.

Attorney Michael Curran came before the Board informally representing the
petitioner. He stated there is a proposed tenant for the property at 250 Bailey St., and he
is requesting an opinion of the Board as to whether a special permit would be needed to
allow the tenant. The proposed tenant is AAA and they would use the property for a 24-
hour a day dispatch center for tow trucks. The disabled cars would not be brought back
to the site, the site would be primarily to house the dispatch center and for tow truck
parking. The vehicles to be parked on site would consist of tow trucks, pick-up trucks,
and ramp trucks. The towing vehicles would be housed inside the facility and the
employees' vehicles would be parked outside. The towing vehicles would be maintained
and repaired on site, however, no customer vehicles would be brought to the site or
repaired there. Attorney Curran asked whether the Board feels the proposed use would
be permitted due to a prior decision or would require a special permit.

Mr. Carroll stated he would require further time to review the prior decisions and
Attorney Curran's brief before giving an opinion. He stated if a special permit was
needed, a formal hearing would be required.

Mr. Fitzgerald stated he agrees with Mr. Carroll. He stated there would have to
be some guidelines for a 24-hour a day operation. He stated the site has been a problem
in the past because of the number of vehicles located there. He would require to see a
site plan showing that there is ample parking to accommodate employee vehicles and the
work trucks if the petitioner was to go forward with a hearing.

Mr. Pando stated they would possibly need 10-12 employee spaces and 8-10 tow
truck spaces.

Mr. Fitzgerald stated there would not be enough room on site for additional
tenants if the proposed business were to move in.

Attorney Curran stated the maximum number of employees would be on site
during daytime hours and there would be fewer employees at night.

Mr. Pando asked why there would be a mechanic on duty.

Attorney Curran stated the mechanic would service the AAA vehicles only.

Mr. Carroll stated it is the Board's feeling that a special permit would be required.

Dunkin' Donuts - 130 Rovall St.

Mr. Steven Felongo came before the Board representing petitioner. He stated the
petitioner wishes to locate an outside generator at the site. He stated the pad dimensions
would be 23' by 11' and the generator would be fully contained within housing. The
generator would provide back-up for their IT department, to include lights, safety,
computer room and phones. He stated the generator would run 15 minutes once a week
at 9:30 a.m. There are three generators presently at their Randolph location, one of which
would be moved here.

Mr. Pando stated there are condensing units shown on the plan that would require
approval. He asked if the units have been installed.

Mr. Felongo stated they have not.

Mr. Pando stated the location of the proposed generator appears to be taking up
three parking spaces. He asked for a parking count. He stated he feels this is a minor
modification to the site plan, however, he needs more information. He stated the size of
the pad is not shown on the plan, there is no screening shown on the plan, and the two
other pads shown on the plan are in grass areas, which would reduce the landscaped areas
in total. He stated the petitioner should also contact the Fire Department for approval of
the generator.

Mr. Carroll continued the hearing to Aug. 26, 2004.

Bob Dukas - 100-104 Prosl~ect St.

Mr. Dukas stated he has property under agreement with Mr. Razza, the property
owner. He has run into some issues relative to the height and elevation of the structure.
