Mr. Carroll stated the house is considered a corner lot and was built when the
requirements for corner lots were two front yard and two side yard setbacks. The house
know needs to meet to front yard and two rear yard setbacks. The encroachment to the
rear yard setback would be 16' because an open deck can encroach 9' imo the rear yard
setback to a distance of 26' feet. The proposed deck would encroach 16' imo the rear
yard setback.

Mr. Pando stated it looks on the plan as though the proposed deck may be 9' from
the property line.

Ms. Rita Mahoney asked to speak. She stated her property abuts Mr. Febo's
property and she asked whether the extension to the deck would come closer to her
property.

Mr. Fitzgerald stated there is a 5' landscaped buffer area shown on the plan
between the two properties and he asked who is responsible to maintain that.

 Mr. Febo stated he is.

Ms. Mahoney stated a few of the trees along the buffer have died and were never
replaced.

Mr. Carroll suggested the parties discuss the proposed plans and the buffer area
and come back to the Board with their findings.

Mr. Carroll stated the house is conforming in all dimensional requiremems,
therefore, a variance would be required for the porch.

Mr. Fitzgerald asked if the petitioner needs relief for the addition.

Mr. Molway stated he does not believe so. The home is tri-level and a portion of
house is single story. They want to add a second story to the single story portion. They
want to add a farmer's porch for aesthetic reasons.
