Minutes of the Meeting of June 10, 2004. PRESENT: Paul B. Carroll, Chairman James F. Fitzgerald, Jr. Gregory L. Pando ALSO PRESENT: Sue Franco, Recording Secretary Mr. Carroll opened the meeting at 7:00 p.m. in the Salah Hearing Room, Memorial Hall. Blue Hill Sl~orts Grille - 2790 Washinzton St. Attorney Paul Schneiders came before the Board representing petitioner. Mr. James Callahan was also present on behalf of the petition. Attorney Schneiders stated the petitioner is making a name change to his business to Blue Hill Sports Grille. He received approval on October 17, 2002 for his business name to be located on an existing pylon sign, however, the sign was never erected. He now would like to erect that sign, and have a sign over the entrance and signage on awnings over the windows. He submitted drawings of the proposed signage. Mr. Fitzgerald stated the signage on the awnings should be just the name of the restaurant. Mr. Pando stated he agrees, although to be fair, the Board recently approved a sign for Ho Ting Garden which had wording on the awnings other than the restaurant name. Mr. Carroll stated he does not think it should say "bar" on the awning sign. Mr. Callahan stated he would just put the restaurant name on the awnings. Mr. Fitzgerald moved the petition of Blue Hill Sports Grille to change the lettering on the pylon free-standing sign, the sign over entrance and the awnings over windows. The move was seconded and the Board voted unanimously to approve. E~luiserve - 250 Rovall St. Mr. Paul Alfano came before the Board representing Equiserve.

Zoning Board of Appeals Minutes of the Meeting of June 10, 2004 Page 2 of 10 Mr. Pando stated he was contacted by Equiserve and Suffolk Construction. As part of the site plan approval they were granted, they were supposed to construct a sidewalk on public property on Royall St. up to the new Dunkin' Donuts building. However, to put the sidewalk in place, they would have to take more than 20 pine trees, some larger than two feet in diameter. Taking down the trees would also damage the root systems of other trees. He stated his recommendation would be to ask the Planning Board for their opinion because they made the original recommendation and ask the Board of Selectmen because they are in charge of public ways. Mr. Carroll asked whether the Board should treat the matter formally or informally. Mr. Pando stated there is one individual he is aware of who has planted some of the trees that are slated to come down, so he may have a vested interest in the outcome of this situation. Mr. Fitzgerald stated he believes the sidewalk was an important part of the decision because of traffic and safety. Mr. Pando stated it is important to get the Planning Board and Board of Selectmen input because the work would be done on town property and not on Equiserve's property. He stated he feels it could be done informally. Mr. Fitzgerald stated they could do it informally and ask Equiserve to notify abutters. Mr. Alfano stated they are here to ask the Board for advice. Mr. Fitzgerald stated he recalls the original hearing and he would like to see a sidewalk put in. He stated he is glad the petitioner is questioning taking down trees, but he thinks the site should be modified to allow the sidewalk. Mr. Carroll stated he thinks they should consult with other boards before making a decision and research the issue further. He stated they would hopefully have the input of the Planning Board and Board of Selectmen prior to the next hearing. He requested a letter be sent to the abutters asking for their opinion on the issue. He continued the matter to June 24, 2004. Canton Recreation Del~t. - Banner Request Mr. Carroll read into record a request for a banner to advertise the 4th of July festivities. The banner would be hung from June 28th through July 5th. Mr. Fitzgerald moved to grant the request. The move was seconded and the Board voted unanimously to approve.
