 1. OVERLOOK ROAD EXTENSTON SUBDTVTSTON UPDATE

Mr. Tom Houston spoke on the change in the storm drainage system installed
by the developer. The applicant installed a revised system within the layout
at his own risk. He is hoping to install a modified drainage pipe which would
complete that drainage system revision. Other than that, he has responded
to occasions from calls to the Planning Board's office about questions of the
conditions of approval to this subdivision were being complied to by the

developer. Specifically, he spoke about the ledge removal, the installation of
most utilities, and the storm drain system. The hours of operation, and
trucks running uncovered were reported. In regard to drainage, the Planning
Board acts before the ConCom finishes with the applicant. The system
approved by the Planning Board was larger concrete tanks with outlet
controls. ConCom preferred not to have these, but to have conventional
structures and install large outflow pipes. _Jim Burke, the engineer for the
applicant, Michael Bucchieri stated that he has plans and a letter requesting
that the ConCom issue an amended Order of Conditions. They filed today.
They feel if they have to, they can go back and install drainage the original
way.

The Board feels they should allow ConCom to act finally on the drainage
before they weigh in on the modified plan. Mr. Rizzo has to agree to that
drain line.

Dust control- Mr. Pineo suggested that mulch be placed on the dry soil in
front of the neighbor's houses. He agreed to have that in place by Monday of
next week.

Hoe ramming is not completed. Tt is needed for water services up to the
curb stop. The depth is about 4'. This means they will be again within 120'
of the neighbors.

Mr. Comeau pointed out that he noticed six conditions that have been
violated. The six issues were discussed with Mr. Bucchieri. They included
start up time too early, observed no metal plates covering open holes at the
end of the day, equipment being secured on the site, fire hydrant not being
blocked at any time, no closing of the street, without 24 hours prior notice to
all officials, and dust control.

Since Mr. _]enkins has experience in ledge removal at the High School site,
Mr. Burke was advised to seek his advise on the method of ledge removal
preferred in the basin. He agreed to speak with him and report to the Board
of his findings.
Mr. Miller asked about use of the other methods of ledge removal other than
hoe ramming, he explained that the reason for preferring the use of hoe
ramming was it is faster, also for depth.

Attorney Fox representing the Rizzo family on 5 Overlook Road, spoke to the
Board on the change of the size of the water pipe. He presented photos of
the house foundation and trenches in question.

Upon a motion made by Mr. Comeau and seconded by Mr. Miller, the
Board voted to allow hoe ramming with the condition that the use of
expandable grout at the High School site, be investigated through
the expertise of Board member Mr. ,lenkins. Mr. Burke will put
together information on hoe ramming from his experience. Also
that 48 hours notice be given to the Board and to Mr. Houston prior

to any ledge removal. Voted 4-0 in favor.
Any more infractions, Hrs. Hayes moves to have a hearing to rescind the
subdivision.

 2. DESIGN REVIEW BOARD APPLICANTS

 Continued to August 3rd.

 3. 943 WASHINGTON ST. SUBDIVISION: PATRICK
 CONSIDINE/CEC ENGINEERING/RICHARD STAITI, ESQ.

Richard Staiti, Esq. spoke for his client on the conclusion of this subdivision
process. A list of items were submitted to the Board. Tncluded were a storm
management plan, a construction plan, and he did talk to the Chief of Police
concerning signage. The homeowners association agreement was not ready
but will have it ready soon. Under the draft, under item 5, he discussed the
language of preservation that the Board had discussed previously. Other
than naming this road, he believes he had complied with all requests. The
Board wished to discuss the street trees. The restrictive covenant will go
with the lots. The lot with ledge, will restrict the owner of the lot from
removing the ledge. IVlr. Staiti mentioned consulting with the Veteran agent
on street name.

IVlr. Considine objected to the fact that that in this subdivision, applying first
for a Scenic Way waiver was part of the conditions of approval.
IVlr. Considine felt that he could not apply for a Scenic Way waiver since he
did not know the name of the contractor in order to put that name on the
application. The Chairman asked how close the stone wall, if any, was in
relation to the street.

The issue of the Scenic Road by-law was discussed.
IVlr. Considine pointed out that the only item received tonight was the
homeowner's policy.
The approval will be continued to the next meeting of 8/3/05 as the first
item.

 1. name of street
 2. street trees picked (shade trees)not sugar maple or Norway maple
