 TOWN HALL
 SEPTEMBER 21, 2005

Members present: Peter Pineo, Chairman, Vice Chairman, Jeremy Comeau, Dean
Miller, Clerk George Jenkins, and Jillian Hayes.

Suzanne Feigen, Secretary

Citizens Speak No one wished to speak.

7:00 P.M. ANR PLAN-FARM STREET-ALDO BARBAGLIA;PAUL SCHNEIDERS,
ESQ.

Rick Reid of Toomey-Munson Associate was present to describe the plan. It involves
Lot 2A, which redefines the line that divides Lots 2 and 3. They both conform to
frontage, and the lot width was drawn at an angle. Mr. Houston's concern is with
minimum lot width.
Upon a motion made by Mr. Comeau and seconded by Mrs. Hayes, the Board
voted to endorse a plan of land dated (incorrectly 2004) September 6, 2005 by
Toomey Munson 8, Associates, by a vote of 4-0 in favor. The typo will be corrected
to read 2005. Mr. Jenkins was late and not present to vote.

AGENDA ITEM NEXT MEETING: RFP

7:30 P.M. ANR PLAN - PLEASANT ST.-IRIS LLC & NANCY PANDO/SUZANNE
MATTHEWS, ESQ.

Suzanne Matthews, Attorney for the land before the Board, gave a presentation of the
plan. Currently there are two existing lots on the plot; one, vacant, with a razed
house, and one owned by Nancy Pando's mother now. They wish to make them into
three lots. The plan, however, shows three lots and two parcels. Lot 3 has always
been there, pre-existing. They need to go to Zoning Board of Appeals for relief. They
are here before the Planning Board for endorsement on an ANR Plan for Lot 1 and Lot
2. Each have the needed 75' frontage and the necessary width. They also meet the
build factor of 23 or less. The Board requested that the engineer change Lot 3 be
changed on the plan to read Parcel C, and so state this on the plan. Mr. McNeice for
Iris LLC, will initiate the change to the plan.
Upon a motion made by Mr. Comeau and seconded by Mrs. Hayes, the Board
endorsed the Plan of land dated September 19, 2005 b Norwood Engineering, with
the change of Lot 3 to Parcel C. Voted 5-0 in favor.

8:00 P.M. CRISILEO WAY SUBDIVISION-DRAINAGE DISCUSSION-SUZANNE
MATTHEWS, ESQ.

Source page 2

Mr. Pineo explained to the audience that for there is before the Board a wish of the
DPW to have the detention system on Crisileo Way, a newly approved subdivision, on
Walpole Street, moved 10' westerly to get it off Lot 6 and into the Right of Way. The
reason for this is that the Town will not be able to maintain the proposed underground
drainage system as currently designed. Also, if the system is built as currently
designed, the DPW will not recommend acceptance of the road if it comes before Town
Meeting. If the roadway is not accepted, roadway maintenance, rubbish pick-up, snow
plowing and all other services will have to be done privately. Mr. Pineo feels strongly in
support of an Association, and having the detention system on a separate lot. Mr.
Houston spoke to Phil Levreault and the reasoning was to maintaining the detention
basin.

Atty. Matthews stated that her client just wants to go forward and not be stuck between
the Planning Board and the DPW on this. They also request from the Board a request
to waive all fees and additional engineering fees to Mr. Houston. They feel this is a
difference between two Boards and do not feel they should have to pay anymore to
resolve this issue. Mr. Miller does not feel he want to vote on this because he feels he
is putting the Town in legal jeopardy sometime in the future.
Upon a motion made by Mr. Jenkins and seconded by Mr. Comeau, to grant the
request for a minor modification to accede to wishes of the Dept. of Public Works
and that any fees involved, not of the petitioners making, should not be paid by
the petitioner, the Board voted 3-0-2 in favor. Two abstentions, Mrs. Hayes and
Mr. Miller.

8:30 P.M. CONTINUED, PUBLIC HEARING 'WASHINGTON COMMONS'
FLEXIBLE DEVELOPMENT-
 STEVEN DAVID; PAUL SCHNEIDERS, ESQ.

SPECIAL PERMIT PHASE:
St. John's Church, Father Doyle, Steven David, owner, Scott Turner of BSC Group
engineers were present. The site walk was last week. Atty. Schneiders is comfortable
with Mr. Houston, but does not think 90 degree angle can be achieved nor is
necessary.

Mr. Jenkins, feels the roadways really doesn't change. He asked, do we want flexible,
or conventional? If there engineering figures do not fit, now you should show them in
the definitive stage.

Show the lot layout. The conventional plan was shown with access to Washington with
two on Kenney St.
Most would be Form A plans, not coming under a Definitive Plan. They could start
building tomorrow in the Form A's. They would Covenant Lot 5 for recreational use.

They met with the Trails Committee, and there are some steep areas there. They did
not feel that this would be ideal for any trails. Carl Lavin was present and spoke on the
Trails Committee. This particular lot does not meet where a trail would fit. He would like
a crosswalk down Kenney Street to have access to the sidewalk on Washington Street.
Also, he would like signage for a crosswalk. Perhaps, pruning some trees in back of
St. Mary's Cemetery to see the vista, would also be nice. Mr. David had no problem
with agreeing to these items.

The developer will agree to a Tot lot on the site. He indicated on the plan where he
would locate this lot. The lot would be approximately 1,000 s.f. Mr. David was very
agreeable to a Tot Lot. During the Definitive Subdivision part of this process, the
equipment used for the Tot lot will be picked out. The range would be 2-5 yrs. old In
age for the children.

Atty. Schneiders spoke to covenants in regard to comments of Mr. Pineo to concerns at
the corner of Washington and Randolph Streets. There are two deeds. These are
agreed upon in the covenants and Atty. Schneiders could do conditional documents
that involve granting of the Definitive Plan. He will get the deeds executed for $1.00.
to the Town. He will draw up for Town Meeting, acceptance of the Deeds, and at the
same time raise and appropriate money to fix intersection at the Randolph and
Washington Street.

$275,000. plus the land at the cemetery is to be given to the Town of Canton. With
that, they can improve the intersection, or roadway, or anything they wish to do with it.
The developer declined to offer the undertaking.

Atty. Schneiders will come up with a Homeowners Association document which
includes amenities and maintenance program.

Suggestion: Assisting the Garden Club in the future.
