7:00 P.M. TOWN OF CANTON PLANNING BOARD MEETING OF JULY 8,2003 MINUTES ANR PLAN-392 YORK STREET-THOMAS THORN/JOHN MOONEY, ESQ. Mr. Mooney represents Mr. & Mrs. Thorn. He clarified that the line across the lots that is solid is not a separation of lot lines, but rather showing the lot width through the building. This is a SRAA zoning requiring 75' frontage. Both lots meet that and they are on a public way, York Street. There are some variances being sought for both lots. Lot 1 there is a build factor of 28.92, exceeding the 23 in the By-law. Also, the lot width through the building is 122.76', with 200' required under the By-law. On lot 2, because of the shape of the lot has a build factor of 25.68, exceeding the 23. Variances are being sought through the Zoning Board of Appeals. The Chair indicated what was in compliance with an ANR plan. The one question is whether he needs to put on the plan, that it is not a buildable lot, because of not meeting the build factor. There is a case from Dighton in the year, 2000 against the Planning Board of Dighton stating that the Planning Board can not require the applicant to put that on the plan because it is not the function of the Planning Board. It is up to the Building Inspector as to whether they will issue the Building Permit, since they do not meet the build factor. The Chair recommends that even though we approve, he still needs to look at each plan to see that he meets the build factor. Everything meets the criteria. Mr. Mooney stated that originally, the main purpose of an ANR is to allow the plan to be recorded at the Registry of Deeds. No questions from the Board were given. Upon a motion made by Mr. Miller and seconded by Mr. Comeau, to approve the plan for 392 York Street dated May 20, 2003, with a memo to the Building Inspector that he inspects the lots before issuing permits, the Board voted 5-0 in favor. 7:15 P.M. ANR PLAN-132 WASHINGTON ST.-ERNIE CAPPUCCINO/BOB MANONES Mr. Cappuccino spoke to the Board and indicated that he wants to combine the two parcels that are on the plan presented. He owns both lots. The build factor is on the plan. Upon a motion made by Mr. Jenkins and seconded by Mr. Comeau, the Board approved the plan dated 617/03 combining parcel A and lot 1 to make Lot IA. Voted 5-0 in favor. 7:15 P.M. HEIDI SAMOKAR OF MAPC-DESIGN REVIEW GUIDELINES - CONTINUED At the last meeting with the Board, Heidi promised to come in tonight with a camera ready copy of the guidelines. She was hoping for an endorsement of the copy. She was not able to get a copy of the Brooks block. It is not critical. Secondly, she needed to know if the local banks had funding programs for local businesses. Drawings from Roger Nicholas on street lamps are in there now. She needs to scan a copy of the application is 1
