BOARD OF SELECTMEN MINUTES October 18,2005 MEMORIAL HALL Present: Robert E. Burr, Jr., Chairman, John J. Connolly, Clerk; Avril T. Elkort, Member; Gerald A. Salvatori, Jr., Member, William T. Friel, Town Administrator, Judy Nelson, Administrative Secretary. Location: Salah Room, Memorial Hall Meeting was called to Order at 6:01 p.m. Mr. Burr apologized for Selectmen Del Vecchio who unfortunately was detained in Court regarding an ongoing case for his firm. He also noted that Mr. Connolly would be along shortly as he too was completing an obligation for work. STM: Article 10: Proposed Plymouth Overlay District Article: Mr. Burr informed the residents that the Board of Selectmen met with the Planning Board in Executive Session over the weekend to discuss this Article. He noted that we have done all we can to work together with the best interest of the town in mind. Mr. Connolly informed that negotiations have been going back and forth since as far back as January trying to negotiate with the best interest of the town in mind. He noted that he had Ijved across from the Plymouth Rubber area for ten years. That all being said, in trying to work with them and a local developer, Mr. Terry Conroy, who in fact wanted to work with us. Unfortunately at this point in time, the deal fell through. We are hoping to come back at a later date to work something out. We must be very careful as to what we place in this area. It is important and is of course a once in the life time opportunity. Once this is done, there will be no going back. This is very important to everyone and we as the Board do not take this lightly. We are disappointed that we could not at this time work something out. Several abutters to this area spoke about the importance of the water rights control, noting that this past weekend's storm was a perfect example of why we need to control this area. They also noted that Plymouth Rubber has always worked with the abutters to make sure this area was safe and accessible. They asked that they be kept informed as to the progress of what is going on in this area as this will impact their community Motion was made to withdraw this Article without prejudice. Motion: Mrs. Elkort Second: Mr. Connolly VOTE: 5-0 Mr. Burr suggested that if there were any further questions regarding Plymouth Rubber, perhaps they should be raised at Town Meeting. Frank Keefe who resides at Four Meadow Lane approached the Board and asked ifthe bankruptcy court action put everything into limbo now regardless of what you want to do or not want to do? In other words, is there intermediary between the Board and everybody and that is the Bankruptcy Court which takes precedent over every other entity as I understand it. Mrs. Elkort noted that we have discussed this with legal counsel who clarified the Town's options. She noted unfortunately we will not be able to collect the unpaid taxes owed to the Town at this point. Mr. Friel noted that he did not think that there was anything relative to the bankruptcy that would prevent the town from speaking to and through the bank prospective parties which would be in the best interest of the Town. The bank is going to position themselves in a way as to get the highest and best on their return. Their responsibility is to make sure that the highest and best amount can be secured for the debtors and others that are involved, but as far as the town acting outside of this, a developer would have to urge the town to pursue any further to keep this alive. It has been inquired as if this would be something that we could bring to the Annual Town Meeting in about 90 days from now. Unfortunately, this does not give us a
