- 2 - Congratulations to all. Mr. Jenkins made a brief statement. He would like to go forward in a cooperative sense. He would like rumors of an investigation to stop. He received a call while on vacation in South Carolina concerning this rumor. 2. ANR PLAN-25 CHAPEL STREET-LOT 2 AND LOT 2-JOSEPH AND MICHAEL KELLEHER ATTY. SUZANNE MATTHEWS Atty. Matthews spoke on the plan before the Board tonight, that this is a division of property at 25 Chapel St. Around twenty years ago, Mrs. Kelleher entered into a lease agreement with Schlossberg Chapel that allowed them to lease and use a driveway to the back of the Chapel. The heirs of the property on 25 Chapel Street would like now to deed that property to Mr. Schlossberg. The Kellehers are going to make the existing home into a two family house. They have been before the Zoning Board already. Mr. Comeau asked if Schlossberg Chapel had the approval of the Board of Directors that authorized this transaction. Atty. Matthews stated that there is no corporation that owns the property that is being divided. The Kellehers own Lot 1 and Lot 2. Upon a motion made by Mr. Comeau and seconded by Mr. Connolly to endorse Plan of Land dated May 1, 2006 at Chapel Street by Norwood Engineering, the Board voted 5-0 in favor. Discussion: to the right of the line is in the CCEOD. 3, INFORMAL DISCUSSION: "TURTLE CREEK' SUBDIVISION - PATRICK CONSIDINE Mr. Connolly has recused himself from this item of discussion. Atty. Moynihan spoke to the Board tonight for the reason setforth that after the walk through of the site on Saturday last, Mr. Houston would comment. Mr. Houston spoke on Road B and asked if they had considered eliminating that road and considered using Flexible Development on the property. This would result in lower environmental impacts. Mr. Houston mentioned that he is meeting with the applicant's engineer to go over issues raised in the review report. Mr. Jenkins likes Flexible Development. If we cut down on the roadway, everyone is the winner. Mr. Considine is open to the suggestion of Flexible Development. He would like this not to be at his economic detriment. He will work as hard as he can to keep as much open space as possible. He believes that the economic detriment is both time factor and construction costs, as asked by Mr. Jenkins. Engineering costs on a site of this size are high. Mr. Comeau believes in the Flexible way to go. Mr. Miller feels that with the two lots along the road, it would be difficult to build out. Is there a issue with regard to the new Town Meeting Article pertaining to wetlands. Mr. Jenkins stated, no that the subdivision application was submitted prior to the Article. Mr. Miller would like Flexible Development, but is not clear as to the number of lots, as of right, to be built on. Mr. Considine feels they have 50,000 cu.yard surplus. He firmly believes that he has demonstrated he has an "as of right" subdivision, and all of the lots are viable lots. It may take more reassurance on their part. It is the desire of the Board to go to a Flexible Development. Mr. Considine assumed that there would be one road off Lynn Street, as opposed to a road off Village Gate Road. He is prepared to come back to the Board at the next meeting to show the Board a lot layout relative to a Flexible Development, by eliminating a road. Mr. Houston would like to see a shortening of the overall roadway system, for example, lot width, etc. Mr. Considine was looking at reincorporating the two lots into Road A, perhaps by putting in Res.A instead of present Res.AA. But making the other lots in the rest of the site smaller would have an impact to him. A "limited flexible development" may work, stated Mr. Considine. 2
