4. PUBLIC HEARING-7:30 P.M. DEFINITIVE SUBDIVISION "TURTLE CREEK' AT VILLAGE
GATE ROAD -PAT CONSIDINE/DENISE MOYNIHAN, ESQ. (Due 9/28/06)

Atty. Denise Moynihan, Patrick Considine and Ken Buffard were present. She stated they will be getting
together sometime on the plan. Tom Houston spoke and mentioned that he is hopeful for a Flexible
Development. With respect to the alternative access configuration, that the Lynn Street location was
problematic. The two access points now proposed are much safer and better access. Engineer issues are
fairly straightforward. There are issues with Conservation Commission that need to be addressed.

Atty. Moynihan asked if the Board has any comments on this amended plan.

Mr. Miller mentioned that a couple lots may not be developable, #21 and 22., because of the easement
restriction and embankment. This can be addressed at their next meeting of the engineers. Mr. Houston
stated the land on the Southerly side of Road B slopes downward. He lists four additional waivers. Two will go
over. None are insurmountable.

A list of developer requirements were given to the Board if a Flexible Development plan is used.
Ken Bouffard, engineer, explained that this plan was reworked and the previous plan had a net fill removable of
17,000 yards. With this plan, they have less removable.
The Board will accept a fully engineered definitive plan, and the reviewed plans in 30 days with statement of
agreement showing access.

Mr. Considine wants to protect the Indian Rock as much as possible. They wish to confine the road as a lane
way for emergency access and be gated.
Mr. Houston stated that there has been precedence for emergency access in prior subdivisions and have been
entirely unpaved. Mr. Considine asked the question if this access is even needed. This would be a Fire Chief
decision. He mentioned if the road could be laid out as a lane way.

Mrs. Hayes stated they mentioned park. Are you proposing a park?
Mr. Considiine spoke about Open Space and walking trails, near the Rock. It is not suitable for playing fields.

Mr. Miller has a concern. Mr. Considine explained that they have 50% of the whole land area is being
dedicated to Open Space. But 15% is dedicated as upland area. They exceed the open area by 20% and
they equal the upland area.
Atty. Moynihan explained the question on Conservation Commission's part. They require a concept plan, not a
full blown approval.
Mr. Considine stated that there is a concept that has to be understood. There is a time value here. If they go
into a process where they go to the Definitive Plan process, of which they are ready, they have been here
since November.

Mr. Miller feels confused. He stated, if we decide that Flexible Development is the way to go, then we continue
along with the Flexible Development plan, and that would be the plan that Conservation Commission would
receive. Mr. Considine agreed. The Conservation Commission has received the Definitive plans and the
Flexible plans of which they have 35 days, as other Boards do, to respond or just review the plans.

Mr. Considine also explained although he has submitted the Definitive Plan to Conservation as a matter of
procedure, they cannot go to Conservation until they have received approval from the Planning Board.
They have the plan already.

John Bradley requested that he and his clients have a recess of five minutes to review this plan amongst
themselves.
