- 1 - TOWN OF CANTON PLANNING BOARD MINUTES OF MEETING TOWN HALL WASHINGTON ST. WEDNESDAY October 4, 2006 Members present: George Jenkins, Chairman, Jeremy Comeau, Vice Chairman, Jillian Hayes, Clerk, Dean Miller, and Christopher Connolly. Thomas Houston, from PSC, present. Suzanne Feigen, Secretary The Meeting came to order at 7:07 P.M. CITIZENS SPEAK Noone wished to speak. 1. 955 TURNPIKE STREET-'THE PARK' RECREATIONAL COMPLEX- PETER GIAMBANCO II/PAUL SCHNEIDERS, ESQ. Attorney Schneiders spoke on the new building. The Zoning Board thought that having greenery in the front of the building would look nicer, so Mr. Giambanco swapped the parking lot to the back and put the playing field in the front. The Selectmen issue was to make something available to the Town by way of giving something recreational to the Town. They exceed all requirements. They have four times the lot area required. This is for the construction of a 97,400 s.f. indoor sports arena. Peter Balatoni, with Allen & Majors engineering briefly went over the plan. They have defined the entrance off of Turnpike Street, and located the dumpster in the back. They provided for parking spaces on site for 200 spaces. They have 2 % acres of impervious acres on site. The detention system is in the back, with an infiltration system. Up front is an infiltration system which will take the second half of the roof, as well as the parking lot, infiltrate it, and allow some of the discharge out into the wetland area. Under the 100 yr. storm, this would be a reduction of 78% to this wetland area that presently comes off the site. The landscaping area provided is 5% within the internal portion of the site, as opposed to 6%. They are before the ConCom. The Wetland line shown on the plan was accepted. In the rear, is an above ground system. Mr. Comeau has concerns with the fields being in front. He asked what the distance was between the travel lane (Southbound) and the field in front. It is about 25-30'. Mr. Balatoni stated that the field would be netted. They are also using the field out front for snow storage. The field is slightly raised two feet. It is not a full size field. Mr. Miller raised his concerns about the field being so close to the road. 1

- 2 - Mr. Jenkins feels we should do something to protect the players on the field in that field. He spoke about moving the field in ten feet. Mrs. Hayes asked if they could shave a little off the building. They did not think so. They need to go to Mass. Highway for the curb cut permit. They may shrink the size of the field a little. Audience: Peter Gefteas, Turnpike Cafe- has two concerns that pertain to the small detention area and the recharge facility. He mentioned what the Mr. Murphy had advised at Conservation: 1) that water backs upward. He feels the detention area will flood. 2.) He stated that Mr. Murphy said to be very careful because if you don't account for it backing up here, you could flood Boston Drive. He would like this applicant to do what the car wash facility is doing, by putting the a large detention area in the front. He would like the ball field in the front eliminated. The second concern is with the recharge facility. With the high water table, he feels there will be flooding. He again reminded the applicant that they took the roof runoff and graded it towards the rear. He spoke with Mass. Highway, and they are going over these plans. He feels it is a determination of the Board to determine whether the applicant is willing to take a chance and hope that the drainage does not flood the street or sacrifice the ball field. Mr. Miller asked about the mosquitoes there. Mr. Jenkins asked about the roof runoff. There will be gutters on eaves that run to roofleaders. The leaders will go underground. If the soils allow, then to do that, the engineer will design the drain gutters towards the back underground system. Mr. Jenkins was asked if a site walk could occur. He has no problem with that. He will get together with Mr. Schneiders for coordinating with the Board. Atty. Schneiders thanked the Gefteas for their letter. The Board members will visit the site independently. June Alfano asked what ever happened to the Conroy Report? In the 1980's. 2. 7:30 P.M. SCENIC WAY PUBLIC HEARING-BY-LAW CHANGE Upon a motion made by Mr. Comeau and seconded by Mrs. Hayes to open the Public Hearing, for the Scenic Way By-law Change at 7:00 P.M., the Board voted 5-0 in favor. Upon a motion made by Mr. Miller and seconded by Mr. Comeau to waive the reading of the Public Hearing, the Board voted 5-0 in favor. Mr. Comeau spoke to the violation fee that is presently in the State Statute. Their fine is defined at at least $300. Chp. 40, s. 15C. was being referred to. Town Counsel has stated that in the Towns he has represented, it has worked out very well: if trees are taking down, and if you take the size of the tree that was taken down, and if the owner cannot find a tree that size, than the owner would have to buy a number of trees. Than those trees, add the caliber up, and that equals the one tree taken down in violation. 2
