CITIZENS SPEAK
Noone wished to speak.
1. ANR PLAN-216 MESSINGER ST.-DAVID REZZA/PAUL FELDMAN/
SUZANNE MATTHEWS, ESQ.

Atty. Matthews requests that the Board endorse the plan before them tonight. There are three
parcels of land under common ownership. They have been before Zoning Board of Appeals
seeking relief on lot width through the building on Lot A, and Lot B needed relief from the Build
Factor. The relief was granted, and a copy of that decision was available tonight. Lot A has a
house on it, and will stay. Lot B will have a new house built on it. Lot C is a non buildable lot.
They will approach the Town to see if they are interested in acquiring it for Open Space. Parcel
B was granted a variance from frontage, and granted a variance from lot width on Parcel A, and
a variance from Build Factor on Parcel B.

Mr. Miller had questions on the parcel ownership.
Mr. Houston commented on the term Parcel on the plan. That term should be Lot, maybe.
Mrs. Hayes feels it is their choice.

Upon a motion made by Mr. Miller and seconded by Mrs. Hayes, to endorse plan of land
dated 8/16/06 for 216 Messinger Street along with the Zoning Board of Appeals Decision,
and with the ANR Stamp on the plan, the Board voted 4-0 in favor.

2. LOT RELEASE REQUEST-CEDARCREST VILLAGE-JAMES SALAH/
SUZANNE MATTHEWS, ESQ.

Atty. Matthews is requesting lots 1-10 be released from the covenant. The Cost of Complete
Estimate is $140,000. Her client believes that this is high in some respects. Mr. Salah

explained that they have a completed "As-Built" plan; the loam and the hot top figure is not
right, because he did not get this estimate report until late today. He would have liked to have
had the time to go over it better; the underground utilities have been done; the loam is screened
and it is waiting to be put on the ground.
Mr. Houston stated on the drawing, he would expect a signed and sealed drawing by a Land
Surveyor. He boosted the bituminous concrete, gazebo estimate, but would be willing to sit
down and go over this with him.

Mr. Miller feels they could sit down later, but for now the lots being released are the question for
release now.
Mr. Houston feels that he could take down the As-Built plan cost to $1,000. and with the
contingencies, $5,000. bringing it to $135,000. Also, on the loam, the cost could be reduced by
$6,000. thus bringing the total to $129,000. And $2,500. can be reduced from the tons of bit.
concrete pavement cost equaling $126,500. for the bond amount.

Mr. Miller spoke about the policy of holding a lot plus holding a bond.
Mr. Houston explained that the Rules and Regulations state that the final lot shall be released
and the amount of the surety shall not be reduced to less than 10% of the original surety until
street acceptance.

Atty. Matthews understood that she had been told that they had met the requirements and all
ten lot would be released tonight.
Mr. Miller feels that there was a misunderstanding, and that one lot must be held plus the bond.

Upon a motion made by Mr. Miller and seconded by Mr. Connolly to accept the surety in
the amount of $126, 500. for the Cedarcrest Village Development, the Board voted 4-0 in
favor. The surety will be held in a bond.

Upon a motion made by Mr. Miller and seconded by Mr. Connolly to release nine lots of
the 10 lots in Cedarcrest Village Development, holding one lot, the Board voted 4-0 in
favor. Mr. Salah will pick the lot to hold when he sets the bond.

Mr. Salah and Atty. Matthews were notified that there will a workshop on consultant engineering
policy and fees. It will be a public meeting. They acknowledged that they will attend.

3. LOT RELEASE REQUEST -SOUTHFIELD ESTATES-ALDO RUSCIUTO /
PAUL SCHNEIDERS, ESQ.

Atty. Schneiders explained that the Board is holding Lot 5 and Lot 7 plus $100,000.in cash
regarding his clients partnership in this subdivision. His client would like to have Lot 7 release
from the Covenant so that he can sell it. The lot is worth $500,000.

Upon a motion made by Mr. Miller and seconded by Mrs. Hayes to accept the Certificate
for Lot Release for Lot 7 on Southfield Estates, the Board voted 4-0 in favor.

Mr. Comeau spoke about urging the Board members in sending a letter to Mr. Giambanco to
