Chairman Jeremy Comeau called to order the Planning Board meeting of
September 18, 2013 at 7:00 p.m.
1St Item on the Agenda — 95 SHERMAN STREET- ANR (Division of Land to Create
Lots 1 and 2) (Springdale Gardens, LLC).
Scott Lenhart introduced himself as part owner of this property. They are proposing to
create two (2) lots in accordance with the ANR plan they submitted. One lot will have 75
feet of frontage, the other lot will have 100 feet of frontage, and they meet the other
dimensional requirements.
Valerie Metsika, 62 Sherman Street, stated that the Board should carefully consider this
plan. First, are the Plans certified? This doesn't qualify as an ANR; it is a scenic way; it
is the bare minimum between the house and the lot line; this is historic property and
should fall under the Zoning Laws; it is an aesthetic violation; she opposes the Plan, it is
an eyesore; the neighbors need to put their foot down and they have not been given
respect.
Mr. Comeau explained that the Planning Board has no jurisdiction over zoning
requirements. Our hands our tied and it is under state law. If the Application has access
and frontage they have a right by law, and if anything is removed, for example, stone
wall or trees that are on Town Property, they have to get permission from the Planning
Board. Further, he stated that the house is historic and seeing this is on scenic way the
builder should build something in character with the existing neighborhood.

Mr. Lenhart stated that he is planning on keeping most of the larger trees and utilizing the
same curb cut. He will shed as much light as he can, not be coy and be a good neighbor.
He is not going to build something that is not marketable and a new home will be
aesthetically pleasing.
Mr. Wallace Gibbs of 6 Lamb Lane introduced himself as a resident and member of the
Historic Society and stated that there were 22 historic homes on Sherman Drive. They
were all built over 125 years ago, but are not on the National Register. He would like the
builder to do a design of the proposed house with an architectural structure that matches
the area and the style of the existing homes.
Kerry Perry of 76 Sherman Street asked if both lots will be non - conforming.
Mr. Lenhart explained that both lots will be conforming and meet all dimensional
requirements. He further stated that he needs a vote to be taken tonight because his
financing from the Bank is contingent with him obtaining Planning Board approval.
Barbara Walsh of 52 Sherman Street stated that she couldn't do a stone wall or put up a
fence on her property. She wants the Board to know that she received no notice of this
meeting and was surprised to hear about it this morning. This should be made public and
a note should have been placed in her door.
Mr. Comeau explained that there are certain issues in which abutters are notified but in
the case of an ANR, Approval Not Required, under state law we are only required to post
the Agenda with the Town Clerk and on the Town Website. Also, under state law, an
ANR plan has to be acted on 21 days from when the application is filed and if we don't
act on this tonight, the Applicant automatically can go forward, so our hands are tied and
we need to act on this tonight.
Barbara Walsh further stated that in her line of business she knows about building and
she walked the property, and knows she trespassed, but this plan is not correct and she
only measured 110 feet. She concluded that she has been very upset about this issue
since last week when she found out about it.
Bruce McCuen of 72 Sherman Street stated that this house is not going to be accurate
with the surrounding homes. It is just a quick fix and who will want to buy a house that
is built in front of an old house.
