Zoning Board of Appeals Minutes of February 11, 2010 Page 2 of 4 CPG Campanelli – 5 Campanelli Cir Minor Modifications to Site Plan (wants to put ramp to dumpster). See letter dated January 19, 2010, to the Board from Atty. Schneiders outlining the reasons for this hearing and the modification to the site plan. Joe Hanlon also appears with Atty. Schneiders. 3 reasons to be here: req. for parking + 5, wants to reduce, Shift parking area 5 ft to the west, and access parking to the elevator in the building, side entrance now to be front entrance. Chairman Carroll asked if they were going to the Planning Board informally? YES, it was review ed by the Planning Board on 2/3/10. Mr. Hanlon said that the parking was non-compliant, it is too steep. Mr. Pando states his only concern was the petitioner came in with an educational use, requiring 100+ parking spaces, now only needs 50. under office use in Zoning, you are required to have 190. Institutional use – no requirements. Office use is not sufficient for educational use (i.e. Bay State Technology School). This petitioner can come back and ask for more. See 4.01.4 assembly. Atty. Schneiders said if the use changes or parking is not sufficient they would come back. Mr. Pando stated the Board reserves the right to modify the number of parking spaces as the need arises or amend this decision. He defers to Mr. Feeney for Handicap Parking requirements. Mr. Feeney said the parking lot is reconfigured in a practical way, the side entrance is now the main entrance (like the library and town hall) HP should be 7 spaces. Including one van space. Chairman Carroll stated he was glad Voted Planning Board got involved. Motion made to consider these amendments minor. 3-0 to approve. Motion made for modification of a site plan to add 50 parking spaces, handicapped parking, grading, paving, in accordance with drawings by Tetra Tech Of Braintree, dated Sept. 18, 2009, revised 2/2/10, a minor modification made in accordance with site plans regarding parking. Board retains the right to modify if Board Voted 3-0 to approve. feels it is necessary. SCHEDULED HEARINGS Rite Aid – 4-22 Washington St – 06-10-SP-V Increase size of sign on building, add shield (already has old prior decision granting 145s.f.). Chairman Carroll reads petition. Atty. Joel Fishman represented Rite Aid. Philip Marshall, the regional construction manager was also in attendance. They will be removing the current sign and rearranging it and adding the “shield”. Chairman Carroll said he was concerned with the size, there are hundreds of stores in that area. This is almost a 200s.f. sign. This would establish a precedent. Mr. Pando stated that most new signs coming in with smaller signs. I get happy. The fact that this Board approved a 145 s.f. sign surprises me. I’d be disinclined to approve this. I would like to see 100 s.f., you are already at 145 s.f. 196 s.f. is not acceptable. Mr. Feeney said that he shares Mr. Pando’s feelings. Redesign the sign into by law dimensions would be a good thing. Chairman Carroll asked if the shield was so important, couldn’t you reduce it to 145 s.f.? Mr. Pando said he had no problem if you want to take the sign down and replace it with a 145 s.f. sign. Atty. Fishman said the new sign with the shield at 145 s.f., as a matter of right, old one is ok. Motion made for Special Permit granted to allow a new sign for Rite Aid Pharmacy to include a shield to be affixed to the canopy, not to exceed 145 s.f. per
