Minutes
Board of Selectmen
November 12, 2013
Memorial Hall - Salah Meeting Room
Present: Gerald A. Salvatori, Jr., Chairman, Avril T. Elkort, Vice-Chairman, Victor D. Del Vecchio,
Member, John J. Connolly, Member, William T. Friel, Town Administrator, Jennifer Bright, Administrative
Secretary.
Meeting was called to order at 6:05 p.m.
It was noted that Mr. Burr was present for the meeting as he had recused himself.
Mr. Marathas, owner of JNM Hospitality, was asked for an update on the status of the transfer of its
liquor license for Centerfields. Mr. Salvatori noted that no application had been received by the
Selectmen's office as of yet and the Board's deadline had passed.
Mr. Marathas noted that the arrangement between himself and the latest buyer was on hold pending a
lien on the business condo owned by Mr. Marini, where the restaurant is located and a December 2,
2013 court hearing date on "possession" of the restaurant is scheduled so he was unable to prepare an
application.
He noted that he had sent a formal request to appear before the Zoning Board and had asked the
Building Commissioner to issue a finding on the parking situation, but hasn't been given a date for that
hearing.
Mr. Salvatori reviewed the chronology of the JNM Hospitality Liquor License matter which began in
February of 2013. He noted that the process has allowed the matter enough opportunity to be fully
vetted and that the Board is balancing the public need and convenience along with fairness to all parties
involved.
Town Counsel, Paul DeRensis, spoke on the matter. He added that the lease on the unit had expired in
September of 2012 and that the business had ceased operations since on or abour January of 2013. He
noted that under MGL Ch. 138 section 77, the Licensing Authority may, after providing a reasonable
opportunity to transfer the license, cancel any license if the licensee continues to not conduct business.
Motion was made to revoke the JNM Hospitality Liquor License based on the discussion by the Board of
Selectmen and Town Counsel recommendation and issue writted notice to Mr. Marathas.
Motion: Mr. Del Vecchio Second: Ms. Elkort Vote: 4-0-1 (Mr. Burr
had recused himself)
Motion was made to adjourn the meeting at 6:16 p.m.
Respectfully Su itted,
John J! ol
