Attorney Paul Schneiders introduced himself, Paul Brodmerkle of Site Design
and explained that he is looking for a vote from the Board tonight. They have
worked with Mr. Houston and he is satisfied with 96% of the plan. There are
minimal changes and understand that the water main is a mess from Pequit
Street through the building, and they know this is the most important issue. Mr.
Houston stated that this is the key issue, and feels that the Applicant should work
with the Water Department on this issue.
Mr. Houston further recommended that the electric service should be
underground and they should relocate the service box. Also, he stated that he
prepared a Second Response to Comments dated January 2, 2016 but had not yet
received a response from Site Design. He is satisfied with the Engineering and
feels the Applicant should contact DPW and work with them and the Public
Works Department.
Mr. Comeau explained that he still has a problem with the open space but he is
happier than he was with the original plan and he is not counting the green roof.
He is glad that the Applicant is saving a historic building and much happier with
this open space, and would like to make a Motion to Approve this project.
Mr. Connolly still had a concern with the Easement Issue.
Attorney Suzanne Matthews stated that he is opposed to this project; the
Applicant has no legal right to drain on someone else's property and there is not a
recorded easement. Further she stated the Applicant has no plans to work this
matter out.
Mr. Jenkins explained that according to recommendation by Town Counsel the
Planning Board has no authority to get into personnel issues and cannot make a
Decision on the Easement that has been going on for over 8o years.
A motion was made by Mr. Comeau and seconded by Mr. Jenkins to send a
favorable recommendation (4 -0) on the a Site Plan for "The Residences at Canton
Corner" 869 Washington Street in Canton, Massachusetts dated June 26, 2015
and Revised on October 14; and December 29, 2015; and in accordance with the
Review from Professional Services Corporation, PC ( "PSC ") dated January 2,
2106; and with a recommendation from Town Counsel, in a memo dated
December 15, 2015, with a condition that the Applicant "must obtain an easement
for the two (2) existing corrugated metal pipes (12" and 24" diameters) that
extend from the property to the south and which would be used for the main
stormwater conveyance from the site."
