Chairman Pando opened the meeting at 7:01 pm and reads the agenda.
Sarah Sylvester — 43 Norfolk Street — 7- 16 -SP -V Lq cv,,IRm
Chairman Pando reads the petition and states the Petitioner would like to create a 3- family
dwelling in a General Residence District. Ms. Sarah Sylvester states she inherited the
property four years ago from her mother and is in the process of selling. Ms. Sylvester
states her mother placed a wall in the basement to create 2 -units with the upstairs
remaining a single unit for a total of 3 units.
Chairman Pando reads Section 8.2 on page 80 of the By -Laws and requirements for a
Special Permit for a multifamily dwelling. Chairman Pando states the Petitioner must have
24,000 s.f. and the plot plan shows 13,000 s.f. Chairman Pando advises the Petitioner to
seek legal counsel before the Board makes a Decision.
Ms. Sylvester asks if she doesn't meet the requirements for a 3- family but it was an
existing 2- family, what can she do? Ms. Sylvester asks if she can put a door between the 2
units in the basement so they are 1 unit again. Mr. McCourt states she should speak to Ed
Walsh, Building Commissioner, to know the current codes and make sure there are 2 forms
of egress.
Mr. Vinciguerra asks if permits were pulled when the basement was divided. Ms.
Sylvester isn't aware. Mr. Vinciguerra states if the lot was closer to 24,000 s.f. then the
Board could consider.
Chairman Pando continues the matter to March 10, 2016 so Ms. Sylvester can talk to Mr.
Walsh and /or an attorney.
Janine Perez, 37 Norfolk Street, states she is opposed to a 3- family since they share a
driveway with the Ms. Sylvester and there already isn't enough parking for 4 cars without
using the easement and blocking their way into their home. Ms. Perez states Animal
Control has been called to the residence and there is trash all over the yard.
Chairman Pando states parking will be looked at on March 10, 2016 and takes her
comments into consideration.
