Canton Board of Health June 6, 2016 Page 2 of 3 TOBACCO VIOLATIONS HEARING On May 23, Jane Pratt, Public Health Nurse, and Canton Police Officer, LT Charles Rae conducted a tobacco sting. Twenty-two businesses were visited, and eight failed when they sold tobacco to a minor without checking identification. In April, Ms. Pratt visited each establishment to remind them about the Town's regulations, and each acknowledged, in writing, that they would comply. They were briefed that the penalty for a first time offense is a fine of $100 and a suspension of three days of sales with the removal of tobacco products from the establishment. Present were representatives of the eight establishments: • Bay State Wine & Spirits, Inc. 2740 Washington Street, Canton, MA • Blue Hill Express, 2740 Washington Street, Canton, MA • Canton Mart, Inc., 569 Washington Street, Canton, MA • Canton Wash and Gas, Inc., 683 Turnpike Street, Canton, MA • Colbea Enterprises, LLC, 2760 Washington Street, Canton, MA • Paula's Package Store, 561 Washington Street, Canton, MA • Prestige Car Wash of Canton, Inc., 925 Turnpike Street, Canton, MA • Turnpike Variety, 323 Turnpike Street, Canton, MA Dr. Goodman began by thanking them all for coming. She told all present that they were not required to speak, but everyone asked did. Many spoke of the actions that had already taken, as well as the plans that they were putting in place to prevent a reoccurrence as a result of this situation. They asked for the Board to reconsider the penalty for this first offense. The Board discussed their options. Dr. Goodman said that everyone was aware of the Town's regulations, and she noted that they are fair. She commented that one-third of the establishments in Town failed, and tobacco, and its related illnesses, is a public health issue that should not be taken lightly. Upon a motion by Dr. Levrault, seconded by Dr. Goodman, the Board voted to fine each establishment $100 and to prohibit all tobacco sales for one day on June 21. The tobacco must be off the shelves, but they did not have to be removed from the premises. Each store must submit a statement of how they planned to prevent the sale to individuals under 21 from happening again. If a store fails another inspection within a year's time, then the penalty would automatically go to the second offense level. This recommendation is not intended to be a precedent or a change of policy. VOTED: 2 — 0. Dr. Goodman thanked LT Rae and Ms. Pratt for their efforts on this issue.
