Minutes Board of Selectmen Executive Session June 12, 2012 Memorial Hall - Salah Meeting Room Present: Robert E. Burr Jr. Chairman, Avril T. Elkort, Vice-Chairman, Gerald A. Salvatori, Jr., Clerk, Member, Victor D. Del Vecchio, Member, William T. Friel, Town Administrator, Jennifer Andrews, Administrative Secretary. Also present were Rick Brandstatter, Canton Development Partners, Attorney Paul Schneiders, counsel for CDP and Attorney Mark Bobrowski, consultant for the Town from Bobrowski and Mead. Meeting was called to order at 8:30 p.m. Attorney Schnieders talked about the land (former Plymouth Rubber site) explaining that it is owned by his clients, Canton Development Properties. He explained their position on how to develop the site and what they plan to present as an article to Annual Town Meeting. He noted that it would be a mixed use development, similar to the down town. He feels this plan is in the best interest of the Town and it will be profitable for the owners. He advised he was aware that an option was for the Town to acquire the property. Mr. Salvatori noted that he had been contacted by CDP and it was explained to him that what was being proposed is 325 total units comprised of 120 for rent with no age restrictions, 60 that would be age restricted and 145 for sale owner occupied with mixed use of professional office space. Mr. Burr voiced his opinion on the feasibility of filling the units especially rental and the enforceability of a covenant with any restrictions. Mr. Bobrowski explained that he felt the area needed further study in traffic, water and civil engineering and a fiscal impact study. He noted that the cost of the study would be approximately $40,000. There was a discussion regarding CDP funding the studies for the development including its acquisition of its site to find the best solution for the Town. Mr. Schnieders voiced his opinion on the fact that there had been a recent traffic study conducted in the area and he felt that there wasn't a need for a second study.

There was discussion concerning whether the Board would be in support of the plan that had been presented to them by Attorney Schnieders and Mr. Brandstatter. The Board generally felt that the area needed more study and could not without further information be in support of what had been presented to them this evening. The Board suggested that CDP consider funding the study as presented by Mr. Bobrowski to find a best solution for everyone. The Board thanked Mr. Schnieders and Mr. Brandstatter for their time. Motion was made to adjourn the meeting at 9:36 p.m. Respectfully Submitte Gerald A. Salvatori, Jr. Clerk
