Executive Session
Board of Selectmen
August 26, 2014
Memorial Hall - Salah Meeting Room
Present: Victor D. Del Vecchio, Chairman, Avril T. Elkort, Vice Chairman, John J. Connolly, Clerk, Gerald
A. Salvatori, Jr., Member, Robert E. Burr, Jr., Member, William T. Friel, Town Administrator, Jennifer
Bright, Administrative Secretary.
Meeting was called to order at 9:20 p.m.
Brightview Senior Living
The Board of Selectmen was presented with a packet of information as a possible settlement to
possible litigation surrounding water/sewer connection fees.
After considering e-mails and a letter dated August 7, 2014 from Michael Glynn, Development
Director, Shelter Development Group, the Board approved the request. The Board voted to authorize
the water/sewer connection fees to be charged based on FY14 rates ($314,990 vs. $542,850). The Board
acknowledged that Brightview had submitted a development proposal while the FY14 rates were in
place. Roll Call Vote: Victor D. Del Vecchio, yes; Avril T. Elkort, Yes; John J. Connolly, yes; Gerald A.
Salvatori, Jr., yes; Robert E. Burr, Jr, yes.
The Board also, as part of the vote, included the requirement that the entire mitigation fee due,
$712,595, be due and payable to the Town of Canton no later than the issuance of the first permit for
any construction work related to the project upon site mobilization. This same provision (upfront
payment) would apply to any future phase should that occur. They added a requirement in the vote to
emphasize the significance of using local contractor preference when Brightview selects various trades.
Mr. Friel also advised the Board of Selectmen that he had consulted with the Building
Commissioner who agreed to review all plans for the project prior to Building Permit fee being paid. The
Building Commissioner will issue a letter to that effect.
