A motion was made by Mr. Panico and seconded by Mr. McCarthy to open the first hearing.
Motion Approved 5-0.
First Item on the Agenda - 468 & 474 NEPONSET STREET — Definitive
Subdivision Plan ("Couyerwood Subdivision") — (Donald & Theresa Hagerty) —
Subdivision of land into four (4) lots; one (1) containing the existing home at 474 Neponset
Street; three (3) buildable house lots; and a drainage parcel (Gregory Driscoll, P.E., Jacobs
Driscoll Engineering, North Easton, MA)
Attorney Matt Watsky introduced himself and stated that the Engineer, Greg Driscoll is
unable to attend tonight's meeting.
Mr. Houston explained that they have been reviewing the responses and the guardrail has
been eliminated and will be adding a lo" high granite barrier and fence on the property.
There is a structural cross -culvert underneath the wetland crossing; and added headwalls on
footings and aligning the joints. The legal issue outstanding is with the HOA and the
requirements.
Ms. Smead stated that sewer grinder pumps are more reliable if it becomes a public accepted

Planning Board AGENDA
February, 2018
Attorney Matt Watsky stated that he will talk to Greg Driscoll about the changes and have
the new pumps and test pits added to the Plans, and refer them to the Town Engineering
Department.
Waivers were discussed, and since only three (3) of the members were at the last meeting,
only those members will be voting on the waivers (Scully, Panico, McDermott):
A motion was made Chairman Scully and seconded by Mr. Panico to approve Waiver
2.5.5.14• From the requirement to stake the centerline of the proposed road as there is an
existing residential driveway where the road is proposed. Reason: It is in the public interest
to maintain access to the property and not have the existing home that is currently occupied
blocked by the required roadway centerline staking. Motion Approved 3-o; Roll Call taken.
A motion was made Chairman Scully and seconded by Mr. Panico to approve Waiver 2.5.6.5
From the requirement that all elevations shall be based upon the NGVD 1929 vertical datum
and utilize the more current NAVD 1988 vertical datum as current state and federal
mapping refer to the newer datum. Reason: It is in the public interest to utilize the more
current vertical datum because state and federal mapping has switched to the newer NAVD
1988 datum and it is easier to compare the project plans to that mapping if they're on the
same datum. Motion Approved 3-0; Roll Call taken.
A motion was made Chairman Scully and seconded by Mr. Panico to approve Waiver 2.5.7.3•
From the requirement that "A locus map encompassing 1 square mile at a scale of 1"=1000'
showing the relationship of the proposed subdivision to the community and infrastructure.
The locus map shall show as a minimum, all existing and proposed roadways, water
distribution, and sanitary sewer facilities, zoning district boundaries, and water courses." to
a USGS map encompassing 1 square mile at a scale of 1"=1000' showing the relationship of
the proposed subdivision to the community and infrastructure. Reason: A USGS
Topographical Map shows the information requested in this section except for the proposed
road. The proposed road is very small in contrast to the scale of the required locus map,
therefore we have shown on the map the extents of the property to more clearly show the
project location. Motion Approved 3-0; Roll Call taken.
A motion was made Chairman Scully and seconded by Mr. Panico to approve Waiver
2.5.27(c). From the requirement that the subdivision ways have to be accepted by the Town
of Canton at Town Meeting in order to release all of the lots subject to covenant. Reason:
Section (b) of this paragraph states that a final inspection of the road by the Board and DPW
is required and therefore the roadway has to be completed. Since the road is completely
finished at that point, no more money is required to finish the road and therefore Town is
already protected from having to take over and finish the road construction. To hold one of
the 3 new buildable lots in the subdivision in addition to the lo% of the original surety
amount is excessive in this small of a subdivision and puts a tremendous burden on the
builder to have to wait for Town Meeting in order to start to build the third and final house
in the development. Motion Approved 3-0; Roll Call taken.
