Pando, Chairman Charles J. Armando John R. McCourt Mike Khoury, Alternate Also Present: Amanda Smith, Recording Secretary Not Present: Paul B. Carroll, Alternate Meeting Held virtually in Zoom Chairman Pando opens the meeting at 6:00 pm and reads the agenda. Daniel O'Sullivan — 65-67 Bolivar Street — 23-20-ENCB-SPA-SP-V Chairman Pando opens the hearing and reads the petition. Attorney Suzanne Matthews states that she is representing Daniel O' Sullivan. She states she has prepared a memorandum and there is a site plan for the project. She states the building is old and dilapidated. Her client wants to raze and replace it with a new three-family structure. They have gone to the Planning Board and Mr. Houston has reviewed it, but hasn't done his report yet. Attorney Matthew state the town has listed the property as a three-family structure. It is non -conforming in lot area, frontage, lot width though the building, lot coverage and rear and side setbacks. They would be increasing non -conformity in lot coverage, front setback, side setback and the rear setback. The only area needing relief is the proposed structure is 35' as opposed to the 30' it is now. On the right -side setback, it should be 10', but the proposed change would be 6.08'. Attorney Matthews states that it would be an improvement to the area. Mr. O' Sullivan would like three condos and he would keep one for himself to live in. Chairman Pando reads a letter in opposition from Hellen Walker of 57 Bolivar Street. He also reads a letter of opposition from Mr. and Mrs. Romolo Debaggis of 76 Mechanic Street. Chairman Pando then reads a letter of opposition from Sue Anne Redquest of 69 Bolivar Street. Chairman Pando states that the building pre -dates zoning. He would like to know from Attorney Matthews when it changed from a single family to a three-family. Mr. McCourt states he is concerned about the size of the structure. He asks how it became a three-family. Attorney Matthews states it has been a three-family for a number of years. Mr. McCourt states he doesn't understand how they demolish the current structure under Section 5. Attorney Matthews discusses the by-laws and case law that allow for this change. There is some discussion of a right of way going through the property. Attorney Matthews states that she just found out about this the day before from an abutter. They are going to look into that issue. Mr. McCourt
