First Item on the Agenda (i) CANTON RESERVE (STILLWATER), (Toll Northeast, Owner; Shawn Nuckolls, Sr. Vice President, MA Division) Requesting the release of the balance of Phase 1 lots #1, 3, 4, 5, 6, 7, 35, 36, 37, 38, 39, 40• Mr. Nuckolls explained that they have established a Bond in the amount of $2.5 Million, and Lot 2 (model home) has already been released. The water & sewer has been completed to the satisfaction of the Public Works Department. They are now working on the punch list. Mr. McCarthy was concerned about what regulations we follow: Town or State. He drove through the property and wanted to know where the sign "Private Way" is, that the Board requested. Also, he is surprised and disappointed that the Applicant has requested to be on previous agendas before they were ready and completed the water and sewer. Mr. Houston stated that everything required has been completed and the Board should proceed with the lot releases. We are under the Town's authority for mandating these regulations.

Planning Board Minutes February 17, 2021 Page 2 of 12 Mr. Curran wanted to thank the Engineering Department and Mr. Houston for all of their help and for going out of their way to get this completed. He will check on the "Private Way" sign and was supposed to have been installed already. A motion was made by Chairman Panico and seconded by Ms. McCormack to Approve the Release of the balance of Phase 1 lots #1, 3, 4, 5, 6, 7, 35, 36, 37, 38, 39, 40, and to allow Ms. Smead to sign the Form when completed. Roll taken, all in favor 4-0 Motion Approved. A motion was made by Ms. McCormack and seconded by Ms. McDermott to open Item #2, 221-225 High Street. Roll Call Taken, all in favor, Motion Approved 4-0. Newt Item on the Agenda (2) 221 & 225 HIGH STREET (ANR) (Lisa Brown, Applicant; Kristine Meaney, Site Design) Paul Brodmerkle of Site Design, introduced himself and explained the ANR. In 1928 there were five (5) separate lots, each with 6o feet of frontage. In 1929, the original house was built at 225 Hight Street in the middle of two (2) lots and never changed. In 1989, the Applicant received Zoning relief to construct a new house at 221 High Street. At that time, the lot met all dimensional requirements except for "Lot Width through the Building." They received a variance for 23 -feet in the required 115400t "Lot Width through the Building" and was granted (92 -feet). An ANR Plan was created to combine Lot 12 and a portion of Lot 13 into one buildable lot at 221 High Street. The variance was exercised and the house at 221 High Street was constructed in 1990, but the ANR Plan creating the new lot was never recorded at the Registry of Deeds. The house at 221 High Street was lawfully built in 1990 but construction was based upon the Plan that was never recorded, so unfortunately the lot currently has a lot line running through the house. The purpose of this ANR is to record a plan at the Registry of Deeds that creates 221 High Street (Lot 12A) as shown on the 1989 ANR Plan, and to bring 225 High Street (Lot 14A) into compliance with current dimensional requirements and to create a new Lot 15A. Mr. McCarthy was puzzled with the description and asked if we should check the explanation of this ANR request. Chairman Panico stated we will go on the reputation of Mr. Brodmerkle and his explanation of this ANR Application. Ms. McDermott stated that this is just a housekeeping issue and cleaning up the existing conditions. N
