A motion was made Chair McDermott and seconded by Mr. McCarthy to open Item #r,
Bullen's Way. All in favor, Motion Approved 4-0.

- Discussion of Contractor Contract; Completion Date; and Tri-Party
Agreement
Chair McDermott explained that she spoke with the Bank and Town Counsel. We had a tri-
party agreement for a three (3) lot subdivision. The fourth lot received a variance and the lot
was sold. We then received a check in the amount of $igo,000, which the bank now claims
was sent in error, and that was the $igo,000 for the tri-party agreement. -
Our goal is for the developer to finish the project. The trees have been ordered; the concrete
has been delivered; Mr. Bullens has spoken with Engineering; and paving needs to completed.
During the phone call with the Bank, Mr. Bullen's attorney stated they plan to start completing
the work as soon as the weather warms up. If we take over the project, it will cost more money
and there will be more for the neighbors to be responsible for.
The neighbors stated that they have lost faith in this whole process. They have had meetings
scheduled and Mr. Bullens doesn't show up. Their big concern is that they will be on the hook
if it is not completed by the developer. This has been going on for over five (5) years, and the
main goal is to get the road done.
